Deadline imminent for NPA over Pistorius’ sentencing

Date: Dec 2, 2016

Friday is deadline for the National Prosecuting Authority (NPA) to file additional papers in the Supreme Court of Appeal (SCA) in Bloemfontein relating to the appeal of convicted murderer, Oscar Pistorius against his six year jail sentence.

The High Court in Pretoria earlier denied the NPA leave to appeal the six-year sentence imposed on the former Paralympian for killing his girlfriend Reeva Steenkamp more than three years ago.

The SCA has already ruled that litigants will have to argue in an open court for and against the application for the leave to appeal. Judge Thokozile Masipa sentenced Pistorius for a second time after his initial conviction of culpable homicide was overturned by the Supreme Court of Appeal and converted to murder.

He was found guilty of fatally shooting Steenkamp on Valentine's Day in 2013. The NPA has argued that the High Court has misdirected itself in finding that the aggravating factors in case were outweighed by the mitigating factors.

The prosecution further contends that the question of minimum sentencing as prescribed by legislation should be considered.
