HC stays order reinstating Gaekwad as BCA president
VADODARA: The Gujarat high court on Friday stayed the charity commissioner’s November 16 order reinstating royal scion Samarjitsinh Gaekwad as the president of Baroda Cricket Association (BCA).
The charity commissioner had said that its order will be operative from December 1 to give BCA time to appeal in the high court.
While the Revival Group said the order was in its favour, the Royal Group claimed that the high court has taken away all powers from the group.
“The high court said that the order under challenge is suspended till the final disposal of the petition filed by Gaekwad with the charity commissioner. The court also directed the charity commissioner to hear the case on December 17 and give a final order on or before December 23,” said advocate Prakash Thakkar, who represented the Revival Group.
“The high court directed the charity commissioner to hear the petition filed by Gaekwad challenging his removal as BCA president and by an association member demanding early election together,” Thakkar told TOI.
Gaekwad was removed from the president’s post during an AGM some months following which he had challenged his removal before the charity commissioner. He had termed his removal illegal and accused the Revival Group of taking revenge on him.
“The high court said that the managing committee cannot take any major policy decisions till December 17 which means all the powers have been taken away from the Revival Group. They cannot spend any money except routine expenditure,” said Devesh Patel, Gaekwad’s advocate. Patel claimed that even Dr Jitendra Patel won’t be considered as the BCA’s in-charge president after this order.
