Congress to inform SC of FCRA amendment impact

The government informs the SC that the FCRA amendment had come through and would protect the Congress and the BJP from the impact of the HC ruling

New Delhi: The Congress party will inform the Supreme Court next week whether it wants to pursue its appeal in a case pertaining to donations to political parties by foreign companies.

Senior lawyer Mohan Parasaran told the apex court on Tuesday that he would seek instructions on the effect of a recent amendment to the Foreign Contribution Regulation Act 2010.

A bench comprising justices J.S. Khehar, Arun Mishra and A.M. Khanwilkar allowed Parasaran’s request and fixed 29 November as the next date of hearing.

Earlier this year, the government amended the FCRA to legalise donations to political parties from certain foreign-owned companies. The amendment ensured that companies which have majority foreign ownership will no longer be treated as “foreign source" for donations to political parties as long as they comply with the conditions on sectoral foreign investment cap.

The case before the Supreme Court arises from two appeals filed by the Congress and the Bharatiya Janata Party (BJP) against a Delhi high court verdict in March 2014, which found the two parties in violation of the Foreign Contribution (Regulation) Act 1976 for accepting donations from Sterlite Industries India Ltd and Sesa Goa Ltd, subsidiaries of UK-based Vedanta Resources Plc.

The Union government on Tuesday informed the court that the FCRA amendment had come through and would protect the two parties from the impact of the high court ruling.
