AHMEDABAD: Two women from Mahisagar district have challenged the appointment of SP N K Amin on contractual basis after his retirement. Amin is facing murder and conspiracy charges in the 2004 Ishrat Jahan encounter case. Justice R M Chhaya has ordered the case to be placed before Justice A S Supehia on November 22 because the later had heard a case against Amin filed by these two petitioners earlier.

This is the second petition that demands removal of Amin from the key post. Earlier, former IPS officer Rahul Sharma had filed a PIL taking objection to the extension granted post-retirement to Amin and another encounter case accused, DSP Tarun Barot. This PIL is pending before the HC.
In the present case, Ansu and Sonal Shukla, who had married two brothers of Shukla family of Virpur village, have filed a quo warranto writ petition through advocate M B Mangukia. The lawyer said that Amin could not have been appointed back in service, when the service rules demand not only suspension but termination from service in such a grave case.
These petitioners had last month knocked the doors of HC accusing Amin of harassing them in connection with a criminal case. They claimed that Amin had threatened the family on pretext of probing an old case pertaining to the death of a person in a fire that broke out in the Shukla family’s office in 2013.
Both petitioners had requested the HC to remove Amin from the post and direct the government to transfer the investigation.
