Islamabad - The Islamabad High Court will take up a petition on Monday challenging the notification of appointment of FBR Officer as Director General Bureau of Immigration and overseas employment (DG-BE & OE).
A single bench of IHC comprising Justice Aamir Farooq will conduct hearing of the petition moved by Syed Rehmat Ali Shah challenging the appointment of Muhammad Yasir Pirzada as DG BE & OC.
Previously, IHC bench had issued stay orders against the notification and issued notices to the respondents directing them to submit their reply in this matter.
In his petition, the petitioner made secretary cabinet division, secretary establishment division, ministry of Overseas Pakistanis and Human Resource Development, Federal Board of Revenue (FBR) through its Chairman and Muhammad Yasir Pirzada as respondents.
Shah challenged the notification dated October 5, 2016 whereby establishment division appointed a grade-19 officer of FBR’s Inland Revenue Service, Yasir Pirzada at the post of grade-21 as DG BE & OE with the approval of Prime Minister of Pakistan.
He alleged in the petition that Pirzada has less than 20-year experience in grade 17 while less than 15-year experience in grade-18 and therefore his appointment in grade-21 is illegal.
Besides DG BE & OE is a promotion post to be filled by the additional DGs of BE & OE. In case this post is filled by transfer, the officer must be a grade-21 officer.
The petitioner contended that the said post is regulated under the rules notified in the Gazette of Pakistan dated March 15, 2012. Under the said rules, a BPS-19 officer could not be given the charge of BPS-21.
He said that respondent Pirzada does not hold the requisite experience as the job description of DG (BE & OE) is entirely different from the job of an Inland Revenue officer who is from the cadre of occupational group meant for the recovery and management of income tax.
Therefore, Shah prayed to the court to set aside the said notification.
