Uttarakhand HC orders removal of ayruvedic university VC for supplying wrong information at time of appointment

NAINITAL: Uttarakhand HC has ordered removal of VC of Dehradun-based Uttarakhand Ayurvedic University after concluding the hearing of a petition which alleged that he had secured the post by providing wrong information about himself.
Yogesh Kumar Pacholia, advocate for the petitioner told TOI, “The VC had wrongly informed about his date of birth. Acting on evidences presented by us, the honourable court removed him from the position with immediate affect.”
Single bench of Justice Sudhanshu Dhulia delivered the order of removing VC Satyendra Mishra, who had been appointed a year ago.The PIL was filed by Neeraj Kumar Dhulia, a resident of Pauri district in August, this year alleging that Mishra who was born in 1949 informed the concerned authorities that his date of birth was 1951.
The petitioner alleged that he has already raised the issue “before all the concern authorities, including the Chancellor and Chief Minister of Uttarakhand through the several representations but no heed was paid” on the representation of petitioner.
Dhulia, in his petition has alleged that according to ‘Uttarakhand Aayurveda University Act 2009’, at the time of recommendation, the maximum age of the recommended candidates for the post of the VC shall not be more than 65 years.
It is interesting to note that Mishra was reappointed as the VC of the institution on January 7, 2015 after his tenure expired in the same month by the chancellor. Mishra took the charge of the post on January 15, 2015.
Later, the petitioner sought information under RTI Act in regard of his date of birth to ascertain the age of the VC which was provided to him on July 27, 2016.The reply of the RTI query revealed that the VC had submitted his bio-data before the institution in which he himself mentioned his date of birth as July 14, 1949.
“According to this information his age was more than 65 years on January 7, 2015 i.e. date of his appointment as the vice chancellor. So on the date of appointment this person did not fulfill the qualifying criteria as his age was more than 65 years on the date of appointment violating section of Uttarakhand Aayurveda University Act 2009,” added the advocate.
