Manimajra resident gets 105 days in jail

The court of Ashok Thathai, first class judicial magistrate, convicted Manoj alias Chaini, a resident of Mauli Complex, Manimajra, to serve 105 days in jail under sections 324, 506, 341 and 34 of the Indian Penal Code.

CHANDIGARH: The court of Ashok Thathai, first class judicial magistrate, convicted Manoj alias Chaini, a resident of Mauli Complex, Manimajra, to serve 105 days in jail under sections 324, 506, 341 and 34 of the Indian Penal Code. The local court -- keeping in view the totality of circumstances and nature of the offence -- has sentenced the convict to undergo simple imprisonment for 30 days for commission of offences punishable under sections 341, another 30 days for the commission of offence punishable under Section 506, and 45 days for the commission of offence punishable under Section 324 of IPC.
All the sentences shall run concurrently.
An FIR was registered against Manoj on the complaint of one Tony in 2013. Tony alleged that he, along with his friend, went to Mohan Sweets at Rajiv Colony, where Shahbaz along with his brother Nausha was already present. When his friend Zakir borrowed an amount of Rs500 from him, Shahbaz while abusing him remarked why he was giving a fake currency note. When asked the reason for the abuse, Shahbaz at once called two more companions on his mobile phone, and both Shahbaz and Nausha caught hold of him till their arrival. After some time, two more boys came there, holding a knife-like instrument, and gave him a blow. When Tony raised an alarm, they fled from the spot, while giving him death threats.
It is pertinent to mention here that when the case was pending for prosecution evidence, Manoj requested the court to record his confession. The accused was given a statutory warning and the implications of his confession. It was clarified to him that he was not bound to make any confession, but if a confession was made, it would be used as evidence against him.
After his confession, he was held guilty and convicted. Manoj pleaded that he was a poor man having a family to support, and he was a first-time offender.
As such, he pleaded for a lenient view against him, because of which a punishment of 105 days was pronounced by the court.
