JAIPUR: Rajasthan high court has asked the higher education minister Kalicharan Saraf to respond to the charge that he had transferred the acting principal of the government law college Sikar on mala fide considerations.
The single bench of Justice KS Ahliwalia asked the minister to respond to the charges. The court said a serious allegation of mala fide is being made against the minister.
Anoopdhand, counsel for the petitioner said, Dr Dilsukh Thalore has been officiating as the principal of the government law graduation college, Sikar, for the last four years.
He had disallowed certain students who were not having the requisite 75% attendance to appear for the exam. The students petitioned against the principal to the minister through the Akhil Bharatiya Vidhyarthi Parishad (ABVP) with recommendations from the local MP and MLA.
Based on the complaints of the MP and MLA, acting principal was put on awaited posting orders (APO) August 2 asking him to report to the commissionerate in Jaipur. Aggrieved by the order of the department the petitioner approached the Rajasthan Civil appellate Tribunal and the appellate stayed the order of APO.
The department disregarding the stay of the tribunal transferred the petitioner to the government Law College at Sirohi. The petitioner said no reason or ground has been assigned either for placing the petitioner under awaiting posting orders or for transferring him. On the contrary, the entire action was based merely on the political pressure as the copy of the said order was forwarded to the minister in reference to his recommendation.
