God only hope: Aditya's mother after Rocky bail

Soon after Patna high court’s chief justice Iqbal Ahmed Ansari on Wednesday granted bail to Rocky Yadav, who allegedly shot dead Aditya Sachdeva in a road rage incident on May 7, Aditya’s mother Chand Sachdeva said she has lost faith in the system and, as such, did not feel like filing an appeal in the Supreme Court.

Gaya: Soon after Patna high court’s chief justice Iqbal Ahmed Ansari on Wednesday granted bail to Rocky Yadav, who allegedly shot dead Aditya Sachdeva in a road rage incident on May 7, Aditya’s mother Chand Sachdeva said she has lost faith in the system and, as such, did not feel like filing an appeal in the Supreme Court.
“If the state government goes into appeal, fine. Or else, Bhagwan se hi nyay ki ummid hai (I will wait for the divine justice),” the late 19-year-old’s mother said at her Swarajpuri Road residence in Gaya on Thursday, adding what was at test was chief minister Nitish Kumar's commitment to bring the culprits to justice.
Asked about the delay in the promised speedy trial of the case, public prosecutor S D N Singh said the accused were resorting to delaying tactics like filing discharge petitions in instalments.
Though police filed the chargesheet within 30 days, the process to frame charges was being stalled by the accused on the alibi of exercising their rights under different Sections of the Criminal Procedure Code (CrPC), the public prosecutor said and added he would press for day-to-day trial after the charges were framed by the court of additional district and sessions judge.
As per the provisions of Section 227 of the CrPC, the accused can challenge the chargesheet and submit a discharge petition. Even in case the discharge petition is rejected, the accused gets three weeks’ time to file an appeal in the high court.
The discharge petition of Bindi Yadav, father of Rocky, has already been rejected and now Tony Yadav, another accused of the case, has filed the discharge petition. Taking into account the timeline of the case, one discharge petition and the three-week mandatory time for appeal takes about a month. The other two accused are likely to file discharge petition one after another.
Going by the strategy of the defence lawyers, legal experts say, the trial is unlikely to commence before another two months.
Without revealing his cards, Rocky's lawyer Syed Qaiser Sharfuddin said his client would exercise all legal remedies available to a criminal case accused.
