Upstairs neighbor ‘diverting’ shower water out of window: suit

A Manhattan man says his upstairs neighbor is “diverting” the water from a shower out the window, and he’s suing for $1.8 million over it.

For months, the family above Eric Shames has been engaging in the “disgusting act . . . on a virtually daily basis,” Shames claims in a Manhattan Supreme Court lawsuit.

The cascading water from Stuart and Jodi Zgodny’s apartment has damaged Shames’ bathroom ceiling, he alleges.

The board of 301 E. 79th St. vowed to take care of the problem, levying fines to tenants of the luxury building who created nuisance conditions, but the board “suddenly, inexplicably, and purposefully,” stopped taking any action on the issue, Shames, 55, charges.

He’s seeking $1.8 million in damages in his lawsuit against the condo board. The head of the board declined comment.

The board investigated the allegations and found them “without merit,” a lawyer for the Zgodnys said.

“My clients are confident the courts will do the same and dismiss this frivolous lawsuit,” attorney Marc Held said.
