First Additional Sessions Judge M A Chowdhary observed that the prosecution did not cite or examine any ballistic expert, who could determine whether the seized weapons were in working condition. In the absence of such proof, the offence under Arms Act could not be proved, the judge said. He also held that the prosecution had failed to connect the accused with the commission of offence through sufficient, cogent and credible evidence.
