BENGALURU: The
high court dismissed a petition seeking a
CBI probe into the death of
DSP MK Ganapathy.
Dismissing the plea filed by Ganapathy's father Kushalappa and brother K Machaiah, the judge on Tuesday noted that an order for a CBI probe cannot be passed merely because a party has levelled allegations against local police.
The family had pinned their hopes on the petition filed on September 15, requesting the court to order a CBI probe into the criminal case, saying they had lost faith in the CID inquiry.
The court said the power to order a CBI inquiry must be exercised only in exceptional situations where it becomes necessary to provide credibility and instil confidence in the investigation or when the incident may have national and international ramifications. The complainant still has an opportunity to submit his protest letter before the magistrate in Madikeri, the judge added.
The petitioner's counsel said the CID had favoured influential persons and did not conduct a proper inquiry.
Ganapathy, who was DSP in Mangaluru, died under mysterious circumstances in a lodge in Madikeri on July 7.
