Punjab, Haryana HC refuses to stay arrest of singer Vishal Dadlani, Congress activist

The FIR was registered on the basis of a complaint by Ambala resident Puneet Arora that Dadlani and Poonawalla had hurt religious sentiments of the Jain community.

The Punjab and Haryana High Court Wednesday refused to stay arrest of music composer Vishal Dadlani and Congress activist Tehseen Poonawalla in the FIR registered against them at Ambala Cantt police station on August 28 for allegedly making defamatory remarks against Jain monk Tarun Sagar, till Haryana government files its reply.

Hearing the petitions seeking quashing of the FIR, Justice Jaspal Singh issued notice of motion to the Haryana government as well as the complainant in the case, Ambala-resident Puneet Arora, to file their replies by September 28.

The FIR was registered on the basis of a complaint by Ambala resident Puneet Arora that Dadlani and Poonawalla had hurt religious sentiments of the Jain community through their tweets on Jain monk Tarun Sagar’s religious discourse.

An FIR was registered under Sections 153-A(promoting enmity between different groups on grounds of religion, race), 295-A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs) and 509 (word, gesture or act intended to insult the modesty of a woman) of IPC.

Earlier Dadlani had approached the Supreme Court seeking quashing of the FIR and stay on his arrest but the Supreme Court bench comprising Justices V Gopala Gowda and Adarsh Kumar Goel had on September 7 refused to grant any relief and asked Dadlani to move high court first.
