A Mountie has been charged nearly one year after a five-year-old boy was struck and killed in Penticton.
James McIntosh was riding his bike across a busy intersection on Sept. 15, 2015, with his brother and father at his side, when he was struck by a truck making a right turn.
The truck was driven by Const. Ace Jimmy Stewart, who was off-duty at the time.
Because a police officer was involved, the case was handed to the province's Independent Investigations Office. Last month, the IIO passed its paperwork on to the Crown to decide whether charges should be laid.
Just six days before the anniversary of McIntosh's death, the province's criminal justice branch issued a news release outlining the charges.
Stewart has been charged with driving without due care and attention, under the Motor Vehicle Act. He is scheduled to appear in court in Penticton on Oct. 12.
