Toroitich appeared before a Nakuru court on Monday.

Through lawyer Ochang' Ajigo, he said he had written to the Nakuru DPP requesting him to examine the prosecution file.

“I have furnished the prosecution with a copy of the letter I wrote to the DPP to see if this matter warrants prosecution especially because the families are discussing settling the case out of court,” said Ajigo.

The prosecution confirmed receiving the letter dated August 11 and asked for two weeks to

peruse the letter and get directions from the DPP

“If the families are working to have the matter settled out of court, we have no objection,"

said

prosecutor Hillary Sungoiyo.

Chief magistrate David Kemei said the case will be mentioned on August 19.
