Flying club eviction stayed for 4 weeks

The Delhi high court on Tuesday stayed its earlier direction of evicting Delhi Flying Club (DFC) out of Safdarjung Airport for four weeks.

NEW DELHI: The Delhi high court on Tuesday stayed its earlier direction of evicting Delhi Flying Club (DFC) out of Safdarjung Airport for four weeks.
In an appeal filed by DFC, a bench of Chief Justice G Rohini and Justice Sangita Dhingra Sehgal said the period of four weeks will start from Tuesday and issued notice to the Centre and AAI seeking reply on the appeal.

A single judge had last month dismissed their pleas challenging the Airport Authority of India’s (AAI) eviction order for alleged non-payment of licence fee of more than Rs 8.3 crore.
In its appeal the Club has contended that the aviation ministry in a letter of October 9, 2012 had asked Airport Authority of India not to enforce the authority’s 2007 decision to hike licence fees till a policy is formulated by the government regarding who would be eligible for nominal licence fees.
Senior advocate Kapil Sibal, appearing for the petitioners claimed that till date no such policy has been framed.
The court then asked the Centre, represented by additional solicitor general (ASG) Sanjay Jain, if any such policy has been framed and listed the matter for further hearing on August 31.
