LAHORE: A petition has been filed in the Lahore High Court (LHC) challenging the appointment of Justice Ashraf Jahan Jamali, wife of Chief Justice of Pakistan Anwar Zaheer Jamali, as a judge of the Federal Shariat Court (FSC). Three lawyers including Maulvi Iqbal Haider, Fawad Masood and Sheikh Nasir had jointly submitted the petition. Petitioners’ counsel stated that Justice Ashraf Jahan Jamali was transferred to the FSC few months after her appointment as the Singh High Court (SHC) additional judge, and without the approval of the Parliamentary Committee on Judges Appointment. The petition added, “Even rules and seniority of sessions judges were ignored when Justice Ashraf Jahan Jamali was appointed as the SHC additional judge.” “Later, the president of Pakistan on September 1, 2014 extended for one-year the tenure of Justice Ashraf Jahan Jamali as SHC additional judge when she was working as judge of the FSC,” said the petitioners’ counsel, and added that she was repatriated to the SHC as additional judge in October 2014 and was made a confirmed judge on August 26, 2015. “She was appointed again as judge of the FSC on August 28, 2015 in violation of Article 203 of the constitution,” he added. He requested the court to set aside the appointment of Justice Ashraf Jahan Jamali as judge of the FSC.
