    NBCC to examine Supertech’s Noida towers for building norm violation

    Allahabad HC had ordered demolition of the two towers in 2014 after it was found that buildings were not being built according to the plans sanctioned by authorities.

    NEW DELHI: The Supreme Court has asked public sector enterprise NBCC (India) to check if the distance between the two towers—Apex and Ceyane—being built by Supertech in Noida was in line with building norms in the city and whether the buildings were built according to the sanctioned plans.

    NBCC has been asked to submit its report within four weeks and the next hearing on the matter will be on September 6.

    The Allahabad High Court had ordered demolition of the two towers in 2014 after it was found that the buildings were not being built according to the plans sanctioned by authorities.

    The case was filed in the Allahabad High Court in November 2012 by the existing residents of Emerald Court who were aggrieved that the two towers were sanctioned without maintaining the mandatory distance of 16 metres between the new towers and their building block, as required by the Noida Building Regulations and Directions of 2010, “making their block unsafe, apart from blocking light and air”.

    When the court gave its order, the two towers were at an advanced stage—21 floors had been constructed in Apex and 17 in Ceyane.

    Supertech had filed a petition in the Supreme Court after which the apex court had has stayed the demolition of the towers but restrained the company from selling any apartments in the two towers in Noida.

    The apex was also told that the builder has complied with its order dated July 25 wherein it had asked Supertech to deposit Rs 5 crore with the court registry.
