THE Central Bureau for Investigation (CBI) has told the special TADA court that the accused in the 1993 serial blasts should also be prosecuted and convicted for waging a war against the country.
The CBI, which will be closing its arguments in the case on Monday, told the court that there is enough evidence for the accused to be convicted under Section 121 of Indian Penal Code.
The section for waging, or attempting to wage war, or abetting waging of war against India, is punishable with death or life imprisonment. Special public prosecutor Deepak Salvi for the CBI said that he had submitted before court that the accused, which includes Mustafa Dossa, Abu Salem, Firoz Khan and Abdul Qayoom, be prosecuted under this section.
Under the TADA Act, section 12 (2), the designated court, if finds even during the course of the trial that an accused has committed an offence under any offence which he has not been charged with, it can sentence the person for it.
During the trial of the earlier set of accused, which included actor Sanjay Dutt, Yakub Memon and other members of the Memon family, the charge of waging war was dropped eventually. The defence will argue once the final arguments are concluded.
