Builders to face MOFA Act in city, CP Yadav

Nagpur: City police chief SP Yadav said on Tuesday that Maharashtra Ownership Flats Act 1963 (MOFA) would be slapped against errant builders as per the latest circular from the state top brass. “In MOFA, punishments in the provisions are not much stringent, but shall apply in relevant cases as per the circular,” he said.
The top cop, underlining the need to improve detection of crimes, also said people’s satisfaction and feeling of security is more important than a positive trend suggested by dipping crime rate.
Claiming that the CCTV project is close to realization, Yadav stressed on increasing the rate of detection and recovery of stolen valuables. Attaching a cultural and social value to mangalsutra, he highlighted the emotional shock suffered by a victim of snatching offence while underlining the need to solve such cases. “The curtailment of street crime is encouraging but we need to crack offences too,” he said.
Apart from the CP, recently joined Joint CP Santosh Rastogi, Addl CP Suhas Warke, DCP Ravindra Pardeshi and DCP (traffic) Smarta Patil too were present along with old faces like DCPs Ranjan Sharma, Abhinash Kumar, Ishu Sindhu and Shailesh Balkawade. Rastogi, an officer of 1998 batch, introduced himself during the press conference.
Replying to queries on the dabba trade case, Yadav said the recovery of data from seized hard disks by forensic experts would decide the future course of investigation, where more names could crop up too. “Zeroing down upon an accused or coming to a conclusion in a white collar crime is a complex process. The cases depend upon the circumstances and evidence coming to fore,” he said.
The top cop admitted that the people now arrested in the dabba trading case did not even know that they were part of an illegal racket. “We are opposing bails before the court in dabba case as per the evidence in hand, and also chasing people who are yet to be nabbed,” said the CP. Yadav also said that JT CP Rastogi’s joining the city police team would help add an expert member to probe a financial scam like dabba trade, given his past work experience.

Despite filing a record 21 MCOCA cases in this year, Yadav faced a barrage of queries on the loopholes in them, leading to easy bail in a crucial one. “I am confident of convictions in the MCOCA cases for which the prosecution sanction was accorded by me. We have no vested interest in implicating anyone in MCOCA until there is substantial evidence,” said the top cop. Speaking of the application of MCOCA on Ashish Kantode and gangster Yuvraj Mathankar, the CP said there was no hue and cry until the stringent act was applied in the case. “MCOCA can be dropped after investigation too, before the case is chargesheeted,” he said. “Several factors are involved in conviction under MCOCA, including witness depositions,” he said.
