Audi driver case: HC denies bail, asks woman to approach lower court

Chennai: The woman driver, who was allegedly drunk when she was driving an Audi and mowed down a carpenter off Old Mahabalipuram Road (OMR) a few days ago, rushed to the Madras high court directly seeking bail. The court turned her away citing procedures. She had fatally knocked down Munusamy in the early hours of July 1.
Justice S Vaidyanathan, before whom the bail plea of Ayswarya Wilton came up for hearing on Tuesday, said she should first exhaust her legal remedies before subordinate courts before approaching the high court.

"The petitioner has approached this court without availing herself of the alternative remedy available before the court below. This court is not inclined to render any findings in this matter for the present, as it may have impact on the issue, when the petitioner approaches the lower court," Justice Vaidyanathan said.
Disposing of the bail plea, he granted her liberty to move the trial court for bail. He also directed the court to take up the matter and decide it in accordance with law, uninfluenced by this order of the HC.
In her petition, Ayswarya said she had tried her best to avoid hitting Munusamy. After the accident, she said she called '108' around 4.19am. Police personnel took her to Saidapet hospital for medical examination since they suspected she was drunk.
She was arrested and remanded in judicial custody on July 2 for offences punishable under Sections 279 and 304(2) IPC read with 185 of the Motor Vehicles Act.
