JAMMU, July 2: 1st Additional Sessions Judge Jammu, M A Chowdhary today awarded three year rigorous imprisonment and fine of Rs 10,000 to Amar Nath and Tilak Raj, who were involved in a fraud case.
According to the police case, a complaint moved by Surjeet Kour, wife of Bajan Singh of Simbal Camp to Chief Judicial Magistrate was forwarded to Crime Branch Jammu mentioning therein that the complainant was owner in possession of 8 kanals and 18 marlas of land situated at village Jajowal in R S Pura.
She being an old lady had executed an irrevocable power of attorney in favour of one Amar Nath on 19.08.1996 at R S Pura, which was registered with Sub Registrar on 20.08.1996, authorizing him to deal with the land measuring 6 kanal and 10 marlas.
However, taking benefit of innocence of old age of the complainant, Amar Nath fabricated general power of attorney with regard to land comprising of Khasra Nos. 191, 192, 193, 203 and 271 total measuring 08 Kanal 18 Marlas and gave the address of the complainant as Chohala, Tehsil R S Pura and by presenting a fake lady, the power of attorney was got registered on 24.03.2003. Based on that power of attorney, Amar Nath executed a sale deed in favour of his son Tilak Raj.
The document–general power of attorney was drafted by some advocates and written by one Hans Raj. After completion of inquiry, a case was registered at Police Station R S Pura, vide FIR No. 38/2008 for the commission of offences punishable under Sections 420/467/468/471/ 120-B RPC and 201 RPC. After completion of investigation challan was presented.
After hearing APP Ajay Singh Manhas appearing for the State, 1st Additional Sessions Judge M A Chowdhary convicted the accused for the commission of offences punishable under Sections 420, 471 and 120-B RPC and awarded three years RI and fine of Rs 10,000 each.
