Bolly’s maa’s sons in property dispute
A real-life Deewar is being played out in the house of Bollywood’s favourite maa Nirupa Roy, who passed away in 2004. Her sons, Kiran and Yogesh, are locked in a bitter dispute over her Nepean Sea Road flat, which according to the current market rates is worth around Rs 100 crore.

The families of Kiran, 45, and Yogesh, 57, share the four-bedroom ground floor flat in Embassy Apartments, which the actress had bought for less than Rs 10 lakh in 1963. The brothers occupy two bedrooms each in the apartment, which is spread over 3,000 sq ft, and comes attached with an 8,000 sq ft garden.

After Nirupa Roy’s death, her husband Kamal Roy became the sole owner of the property. The dispute between the brothers worsened after Kamal’s death in November last year.

Kiran, in his petition to the Bombay High Court, has accused his elder brother of “threatening and intimidating” him to gain “complete control” of the house.

The petition, filed through advocate Zulfiquar Memon of MZM Legal, said that Nirupa had bequeathed all her properties to Kiran, and Kamal Roy in his last will had also named Kiran as the sole owner of the Nepean Sea Road apartment.

The petition seeks an order from the court to permanently restrain Yogesh, his wife and two children, and their servants, from accessing the portions of the house occupied by Kiran and his family, besides equal rights to common areas such as the hall, kitchen, and the garden.

“My mother had transferred all her properties, including another flat, in my name because Yogesh and his wife used to ill-treat her and my father. In his will, which was executed in December 2004, my father had made me the sole owner of the Nepean Sea Road flat as well, but allowed my brother and his family to reside there on the condition that they never enter my parents’ bedroom,” Kiran told Mumbai Mirror on Friday.

Nirupa Roy, born as Kokila Balsara in 1931 in Valsad, Gujarat, acted in nearly 200 movies, and her character in Amitabh Bachchan-Shashi Kapoor starrer Deewar was immortalised by the dialogue, “Mere paas maa hain”.

Kiran alleged that in real life, the actress and her husband suffered a lot at the hands of Yogesh. “My brother and his wife would quarrel with our parents on petty matters, and even caused them physical harm. Yogesh’s family went to the extent of filing a police complaint against our parents,” Kiran alleged.

Mumbai Mirror contacted Yogesh for his version, but he refused to comment saying the matter was sub-judice and he needed to check with his lawyer before talking about the dispute.

Kiran, however, said that Yogesh was trying to “bully” him out of the apartment. “I was the one who took care of my father after my mother’s death. It was his wish that I live in my parents’ bedroom after his death, and he had clearly instructed that my brother or his family should not occupy that bedroom. He had further directed that my brother and his family should be made to vacate the house immediately if they violated this condition,” Kiran said.

Advocate Zulfiquar said that Kamal Roy’s will “clearly said that Kiran Roy was the sole owner” of the Nepean Sea Road flat. “Kamal had also requested the society to transfer the share certificates and other records in Kiran’s name. The house is being shared by two families and there is bound to be friction. We are taking necessary steps to ensure that the interest of our client and his family is secured,” he said.
