Nepal SC dismisses doctors' habeas corpus writ petitions

A division bench of the Supreme Court of Nepal comprising acting Chief Justice Sushila Karki and Justice Gobind Kumar Upadhay dismissed the 10 habeas corpus writ petitions filed by doctors who have been detained.

At present, a consumer can file a case in the district consumer dispute redressal forum where the defaulting entity has its main office or a branch office.

Raxaul: A division bench of the Supreme Court of Nepal comprising acting Chief Justice Sushila Karki and Justice Gobind Kumar Upadhay dismissed the 10 habeas corpus writ petitions filed by doctors who have been detained. The Central Investigation Bureau (CIB) has also been asked to carry out the probe against doctors who were possessing fake marksheets and certificates of Bihar School Examination Board (BSEB).
The doctors on whose behalf the writs were filed are Binita Mandal, Poonam Karna, Saroj Kumar Singh, Pannalal Patel, Nimeshpal Raman, Irshadul Haq and Sriram Ghimre. SC spokesperson Paudel, said the doctors had claimed that they were arrested without serving any warrant of arrest. It may be recalled that the CIB had launched a drive 'Operation Quake' in Nepal and arrested 36 practising senior doctors including six women doctors associated with medical colleges and government hospitals from June 18 to 20, from different districts of Nepal for allegedly using fake and forged BSEB marksheets and certificates to obtain medical degrees. CIB DIG Nawraj Dhakal said, "More than 3000 doctors practising in Nepal possess fake BSEB certificates and 100 such doctors have already been detained by the police after inquiry."
Dhakal also told TOI that a police personnel has also been arrested in Birgunj for possessing fake certificate and remanded to jail. "Around 1400 doctors were dismissed by the Nepal government in 2002 for possessing fake certificates of BSEB, Patna, but this practice is still going on."
Sources in CIB said that around 100 intermediate colleges and secondary schools in bordering East and West Champaran, Sitamarhi, Madhubani, Araria, Darbhanga, Kishanganj districts, where thousands of students take admission every year, manage to procure fake certificates from BSEB racketeers in Patna.
According to reports, a fake certificate and marksheet is available for Rs 50,000. After getting these fake credentials, they get admission in several technical colleges of India or Nepal, added sources.
