Homosexuality : SC refuses to hear fresh plea of LGBT community, asks to approach CJI
New Delhi, Jun 29 (UNI) The Supreme Court today refused to hear the fresh plea of the Lesbian,Gay, Bisexual, Transgender (LGBT) community in the homosexuality matter and asked all the petitioners to approach the Chief Justice of India (CJI). Court ruled, this matter would be clubbed along with the other matters pending for hearing in the constitution bench . A two judge bench of the apex court, headed by S A Bobde and also comprising Justice Ashok bhushan refused to hear the matter and asked them to approach CJI. "We refused to hear the matter and directed the petitioners to approach the CJI whether their plea would be placed clubbing along with other matters pending before the constitution bench" the apex court said today . The plea was filed by five known figures from LGBT community- dancer Navtej Singh Johar, journalist Sunial Mehra, chef Ritu Dalmia, hotelier Aman Nath and businesswoman Ayesha Kapur. The petitioners mentioned in their plea that the sexual preferances are inevitable part of the right to life of LGBT community. While hearing LGBT's petitions challenging Section 377 of Indian Penal Code (IPC) in February, the apex court had agreed to re-evaluate its verdict from December 2013, when it had dismissed a Delhi High Court order decriminalising “unnatural” sex. The top court had sent all curative petitions, which are final appeals available against an original verdict, which sought a re-examination of the verdict to a five-judge constitution bench.
