Gaya: With additional chief judicial magistrate (ACJM) Sanjay Kumar committing the much publicized road rage case to sessions court on Wednesday, it has moved a step closure to speedy trial and day-to-day hearing to bring Rocky Yadav, son of suspended JD(U) MLC Manorama Devi, and other accused to justice.
Rocky is accused of killing schoolboy Aditya Sachdeva for overtaking his SUV on May 7.
The chargesheet in the case was filed within 30 days of the crime.
According to public prosecutor (PP) SDN Singh, some pretrial formalities like framing of charge and disposal of the discharge petition and other objections filed by the accused have to be completed now. "Once these formalities are completed, the actual trial is unlikely to take more than 15 days," said Singh.
Meanwhile, Rocky's lawyer Syed Qaiser Sharfuddin said his client would challenge the application of 302 of IPC in the case on the ground that it was an incidental killing and not a planned murder. "304 of IPC, and not section 302, was applicable in this case," he said. 304 deals with unintentional killing and carries a lighter punishment whereas 302 is punishable with death or life imprisonment.
Meanwhile, hearing on the bail petition filed by Teni Yadav, Rocky's cousin and a co-accused in the case, was deferred till Friday as the ACJM called for the case diary.
