Ahmedabad: A second accused in the Bharuch double murder case, Nasirkhan Pathan, sought bail on Monday after the National Investigation Agency (NIA) failed to file a chargesheet against him within the stipulated time of 180 days.
The special court has issued notice to the prosecuting agency and kept hearing on the bail plea on June 16. Pathan has sought default bail, as granted earlier by the court to another accused person, Abdul Samad, last month.
On May 7, NIA filed a chargesheet against 10 of total 12 arrested persons in connection with murder of two local leaders of Sangh Parivar, Shirish Bangali and Pragnesh Mistry in Bharuch, that took place on November 2, 2015. Chargesheet was not filed against Samad and Pathan.
A few days before the chargesheet, Pathan's wife filed a complaint before the NIA court accusing investigators including the investigating official, ASP Namrata Patil, of coercing both the accused - Samad and Pathan - and their family members to convince them to extract confession and turn approvers.
