Counsel say his client was transferred after he started probe into Billion Tree Tsunami project

PESHAWAR: The Peshawar High Court has asked the provincial government to provide records at the next hearing of Anti-Corruption Establishment former director Ziaullah Toro’s transfer case.

The bench, consisting of Peshawar High Court Chief Justice Mazhar Alam Khan Miankhel and Justice Ikramullah, heard a writ petition on Thursday. The petition was filed through his counsel Qazi Jawwad. The bench was informed that petitioner’s services were handed over to the provincial government and he was posted as ACE director.

The chief justice said since his services were handed over to the provincial government, it had the authority to transfer him. He asked how the petitioner’s rights were affected and how mala fide intentions were involved in the decision to transfer him.

Jawwad replied that the petitioner was transferred with mala fide intentions after he started investigation into Billion Tree Tsunami project.

“The enquiry into Billion Tree Tsunami projects involves the brother and brother-in-law of incumbent chief secretary,” he said. “Therefore, he was transferred with mala fide intentions.”

He said the establishment department secretary forwarded a summary to merge Toru’s services in ACE in view his performance.

The chief justice said there was no record regarding the allegations against the brother of the chief secretary and details about merging Toru’s services with ACE. He ordered the government to provide additional record.

Advocate General Abdul Latif Yousafzai said the petitioner assumed charge of his new assignment and the provincial government failed to submit a reply, As a result, there was no need to issue stay order.

The bench, after hearing the arguments, ordered to provide the record by June 16 and adjourned the case.
