Delhi High Court Monday rapped ED , saying it cannot act like a “super-investigator”. The observation came during a hearing on a plea by Himachal CM Virbhadra Singh in connection with a money laundering case against him.

As per PMLA provisions, ED can request the adjudicating authority for extension on the custody of seized documents, citing “reasons to believe” that they may be relevant to the probe. Virbhadra had challenged ED’s request, claiming it did not have valid reasons to seek the extension. ED has, however, argued that the “reasons to believe” cannot be disclosed to the accused in the course of the investigation.
The bench of Justice Manmohan noted that it would not disclose the reasons to petitioners, as it would impact the probe, but pulled up ED for not disclosing information to the court.
