Cop imprisoned for 30 years after implicating youth

When his legal battle started three decades ago, young lawyer Chandra Pratap Kushwah was aspiring to become a judge. But after having cracked civil judge exam, he could not join the service as he was implicated in a case in Sheopur in 1986.

Bhopal: When his legal battle started three decades ago, young lawyer Chandra Pratap Kushwah was aspiring to become a judge. But after having cracked civil judge exam, he could not join the service as he was implicated in a case in Sheopur in 1986.
Pending the case he could not get an NoC and he had to look for a new job.
Kushwah, however did not give up.
He challenged the fabricated case against him and three decades later on Friday, CJM Sheopur sent the inspector Pradeep Rajoria, who had registered the case against him to jail. Following imprisonment, Rajoria, posted in Agar district, was suspended.
"I have forgotten the count of hearings I attended in the last 30 years. I guess it should be more than 500. I have spent hours and hours in court rooms in Sheopur and saw number of judges handling the case. But I was determined to fight till the end", Kushwah, who now works in the state Industries department told TOI.
Vijay Singh Rathore, his lawyer who was 49, when the case started is now 79. Talking to TOI he said, "It turned out to be a difficult task to convince judges, but at the end of the trial I feel contended."
After spending 2 days in jail, Rajoria was bailed out and has challenged his conviction in a higher court.
It all started in 1983, when Kushwah was a witness in a case against Mahesh Sharma, a constable posted in Sheopur, then part of Morena district.

"I was pressured to change my statement against Sharma but I refused. Then I was threatened not to annoy police or cops would make my life miserable", Kushwah said.
The threat soon turned out to be correct. Rajoria's cook registered petty cases against Kushwah and his two brothers in 1986 beginning the trials and tribulations of Kushwah and his family. Same day, all the three brothers were beaten by Rajoria and his colleagues and were arrested.
With great difficulty, Kushwah also succeeded in registering cases against Rajoria under sections 323 (causing voluntary hurt), 506 (criminal intimidation) and 342 (wrongful confinement) sections of the IPC. "The petty case against Kushwah was registered in back date", said his lawyer Vijay Singh Rathore, "and it took 9 years for the court to drop the charges against Kushwah and acquit him."
Rathore said, "Rajoria was a sub inspector when the case started against him. He attended only 14 hearings and it became difficult to ensure that he received summons. Many times he absconded also and the court passed strictures against him."
On Thursday the CJM court passed the order of 6 months imprisonment. Superintendent of police Agar district, RS Meena said, "I have not yet received the court's order against Rajoria, once I receive it, I will recommend his termination."
