Ahmedabad: On June 16, 2008, Gujarat high court refused to make Vitthal Pandya party to the appeals against the special Pota court's order in connection with his son Haren Pandya's murder. Vitthalbhai was demanding re-investigation, but he was late in filing his application by 352 days. The court rejected his plea seeking pardon of delay on the grounds that it took a lot of time for him to obtain case papers and gather other related material to present his case that the probe conducted by the CBI was not proper and the case was required to be investigated again.
Later, the high court acquitted all accused in this case with a rebuke for the CBI that it had botched the investigation.
HC order on 17-day delay came after 17 years
In October last year, the high court refused to condone a delay of 17 days, on an appeal filed by the state government in 1998. It was a case pertaining to caste atrocity and a lower court in Mehsana district asked the government to pay compensation to the victim. Later, the case could not be proved in a higher court and the state government appealed against the order of compensation. The HC order and its rebuke on the 17-day delay came after 17 long years.
