JAMMU, Feb 19: Despite several reminders from Centre and State Governments for timely submission of Annual Property Returns (APRs), many bureaucrats including senior IAS and KAS officials have failed to submit their details for the year 2015 in time and now therefore figured in the list of ‘defaulters’.
Taking serious note of the failure on part of several officials including senior bureaucrats failure to submit Property Returns on time, Governor N N Vohra directed Chief Secretary, B R Sharma, who heads the General Administration Department (GAD) and Commissioner GAD, Gazzanfar Hussain to submit a status report in regard to submission of Immovable Property Returns for the year ending 31st December 2015 by 29th February and action initiated against every defaulting officer.
Official sources told EXCELSIOR that as many as 11 IAS officials including a Joint Secretary, Divisional Commissioner and two Commissioners had failed to submit their Returns and these officials had also been served with notices from General Administration Department (GAD).
As per the rule 16(2) of All India Services (Conduct) Rules, 1988 all these officials are required to submit their Immovable Property Returns (IPRs) latest by the end of January 2016.
Among the officials, who failed to submit their returns included Arun Kumar, Joint Secretary in the Ministry of Environment, Forests and Climate Change; Shantmanu, Chief Electoral Officer (CEO); Ashok Kumar Parmar, Commissioner/ Secretary, Tribal Affairs; Asgar Hassan Samoon, Divisional Commissioner, Kashmir, Pandurang Kondbarao who is on Inter-Cadre deputation to Maharashtra Government; Ms Salma Hamid who is awaiting order of adjustment in GAD; Tasneem Maajid, Special Secretary Power Development Department; Mohammad Javed Khan, Custodian General; Saugat Biswas, Project Director Rashtriya Madhyamik Shiksha Abhiyan; Neeraj Kumar, Deputy Commissioner, Pulwama and Transport Commissioner, Parveez Iqbal Khateeb.
The GAD had served a reminder to these officials bearing number GAD (Vig) IPRs-IAS/2010 dated February 16 saying, “since IPRs have not been received from your end till date in this Department. So, you are therefore, requested to furnish the Immovable Property Returns for the year 2015, failing which it will be presumed that you have violated the rule position given in Rule 16(2) of the AIS (Conduct) Rule, 1988”.
Ironically, nearly 35% of the KAS officials including several Special Secretaries, Deputy Commissioners, Directors, Additional Deputy Commissioner, Assistant Commissioners, Sub-Divisional Magistrates (SDMs) and several other senior officials also figured in the ‘defaulter’ list. Out of the total sanctioned strength of 515 officials, only 339 had filed their property returns and the remaining 176 had failed to submit the details.
All these officials had been served with reminder bearing no. GAD (Vig) 01-APRs/KAS/2012 dated February 19 for their failure to submit returns within the prescribed time.
In terms of Sub-Section (2) of the Section 9 of the Jammu and Kashmir Public Men and Public Servants Declaration of Assets and Other Provisions Act, 1983, every public servant is required to submit to GAD Annual Returns of the assets held by him and his family members in the month of January every year.
The GAD reminder, which has been issued today by Additional Secretary GAD, Pankaj Sharma says, “in terms of Rule 3 of the Jammu and Kashmir Public Servants Declaration of Assets and other Provisions Rules, 1998, the Annual Property Returns shall be submitted by the public servants in duplicate on the prescribed proforma in respects of all the assets possessed by him and his family members, which shall include assets in respect of moveable property, the value of which exceeds Rs 20,000”.
