ALLAHABAD: The
Allahabad High Court on Tuesday dismissed a public interest litigation (PIL) seeking appointment of “up-lokayukta“ in the state, saying “up-lokayukta“ is appointed by Governor with consent of Lokayukta.
Dismissing the PIL filed by a high court lawyer
Anoop Barnwal, the division bench comprising
Chief Justice Dr Dhananjaya Yeshwant Chandrachud and Justice Yashwant Varma passed the above order after hearing both sides.
Since the Lokayukta has been appointed in the state recently and has taken oath of the office on January 31, therefore, it cannot be said that the responsible authorities are not in a position to appoint the “up-lokayukta,“ the petitioner said in the PIL.
Appearing on behalf of the state government, chief standing counsel Ramesh Upadhyay pointed out to the bench that both the relief claimed in this PIL by the petitioner were not sustainable in the eye of law.
