The District and Sessions Court at Thalassery on Thursday heard the arguments in the anticipatory bail application filed by Communist Party of India (Marxist) district secretary P. Jayarajan and reserved the order for January 30.
Mr. Jayarajan filed the anticipatory bail plea on January 22 after he was named an accused in the case of murder of Rashtriya Swayamsevak Sangh (RSS) worker E. Manoj. He has been hospitalised since January 19 when his previous anticipatory bail plea was rejected by the court.
Politically motivated
Manoj was hacked to death on September 1, 2014. Mr. Jayarajan’s counsel said the charges against him were politically motivated and were without any evidence. The investigating agency, CBI, had told the court earlier that Mr. Jayarajan was not an accused and then named him an accused, the counsel said.
Moreover, the CBI had not submitted the case diary despite the defendant’s demand, he said.
The CBI’s counsel argued that the investigation is an ongoing process. It is not possible to predict the time when a suspect is named an accused, he said. The counsel opposed the anticipatory bail application.
It was also argued that Mr. Jayarajan was given opportunities to clarify before the investigating team. The counsel told the court that Mr. Jayarajan failed to appear before the team in response to notices served on him.
