A copyright infringement suit filed by Brooklyn graffiti artist Joseph Tierney, a.k.a. Rime, against Moschino fashion designer Jeremy Scott for a graffiti-clad black dress Katy Perry wore at the 2015 Met Gala has been allowed to move forward.

After hearing oral arguments by both sides, a Los Angeles judge decided to let the case proceed, agreeing with Tierney's claim that it's likely "the high-profile head designer . . . would participate in the design of its most high-profile garment of the season."

The next court date is May 23.

Tierney initially filed the copyright infringement lawsuit in Los Angeles in the fall. Scott filed for a dismissal, claiming, according to Page Six, that the distinctive designs "were selected and created by a graphic artist .?.?. and completely independently of me."
