AHMEDABAD: In dry Gujarat, a rickshaw driver in Dariyapur had been forced to cough up legal fee and hire a lawyer for himself when he was summoned for questioning in a prohibition case accusing him of bootlegging. The driver's fault is that he and a historysheeter bootlegger -Ghulam Rasool Ghulam Hussain Shaikh -share the same name.
The auto-driver has hired a lawyer to get the mistake corrected from legal records as he is likely to face arrest warrant if he fails to show up in court proceedings.
He has been asked to appear before the court to face the trial in February 2016. Interestingly, a chargesheet has already been filed against the bootlegger in the offence of prohibition that had been registered way back n 2005. As the metropolitan court No 10 was to begin trial n this case, the court issued summons in Shaikh's name.The Dariyapur police served he summons to the auto driver because the document bo re his address Char Musalla ni Pol, Chandan Talavadi at Dairyapur.
It fell on family members like a bombshell, and Shaikh rushed to the lawyer living in the neighbourhood. He told the lawyer that his family in quired in the entire by-lane of the Walled City , but they co uld not find anybody with the same name. On the apparent goof up his advocate Khalid Shaikh did a little investigation in the incident and went thro ugh court documents and fo und out that the cops commit ted a mistake due to similari ty of the name. The Kalupur police nabbed the bootlegger in 2005 and charged him later “The chargesheet carries a photograph of the accused From looking at the photograph, it becomes evident that cops did not bother to verify any detail and created pro blem for my client. We are go ing to seek action against re sponsible police officials for causing harassment and de famation by committing such a mistake, when we will seek quashing of this summons in the court,“ the lawyer said.
