Statement of MP David Pkosing, Petitioner at Assembly of State Parties

Pokot South MP David Pkosing

The white smoke has finally come. We have waited for many days, many people wanted it to come early, but God's time is the best time.

Our two requests that is on rule 68 and auditing of OTP has been successful. It was not easy.

Allow me to speak to auditing of OTP. The prayer in the portion asking ASP to audit how OTP recruited witnesses in the Kenyan cases has been granted by Assembly of State Parties (ASP).

In accepting this prayer, two things have come out very clearly;

One is that ASP which is composed of 123 countries, have accepted the Kenyan narrative that OTP never did a thorough job in witness recruitment in the Kenyan cases. Credible revelations at home of OTP witnesses’ procurement, coaching and fixing has not only entered into the ears but also into the records of ASP.

It is no more a story but a reality. It therefore goes without saying that the current cases of OTP against Kenyans cannot go on as if nothing happened, because something truly happened.

Two is that in the history of ICC, our petition has opened up the office of OTP to scrutiny. This operationalised article 112 (4) and solidify guarantees offered under article 67 of the Rome statute on witnesses impartiality.

As we have seen in the Kenyan cases, there was total lack of impartiality. Because of absence of scrutiny in OTP, it allowed that office to operate with impunity, going against the principles upon which ICC was established. Now with audit, that will be a thing of the past.

I know Kenyans are asking what our next cause of action is. We will not tell you here but rest assured we have plenty.

In conclusion we thank our cabinet secretaries, Amina Mohammed and Rachel Omamo, Our ambassadors and technical staff. You have done Kenya proud. I also thank signatories to the historic petition, without you Hon. Members we could not be here today. Finally I call upon Kenyans to continue praying. We have only opened chapter one.

Chapter two, which is our ultimate PRIZE is next, and that is the freedom of our DP HE William Ruto and our brother Joshua Sang. The chapter we have written today is a perfect introduction to the next chapter.
