2004 Kumbakonam School fire: ‘Conviction too little, too late’

The 10 convicts filed an appeal in the Madras HC against the lower court’s order. In the meantime, the state govt filed an appeal against the acquittal of the 11 other accused by the lower court.

July 16, 2004, was a regular day at school. About 760 children, belonging to three different schools running in the same decrepit building on Kasiraman Street in Kumbakonam, Tamil Nadu, were, however, given an unusual instruction. The students were told to gather on the first floor of the building in order to convince visiting government inspectors that the school had a poor student-teacher ratio and needed more aid. Just as 200 students had gathered on the first floor, a fire lit in the kitchen spread to the thatched roof of the building, and soon engulfed it, killing 94 people, mostly children below the age of nine.

A decade later, when the district court convicted 10 persons for the fire including school founder Pulavar Palanisamy who was sentenced to life, it was only a semblance of justice for the families of the deceased. Their struggle for “full justice” is still on, as they await higher compensation, and keep their fingers crossed over what plays out next in the courts.

The 10 convicts filed an appeal in the Madras High Court against the lower court’s order. In the meantime, the state government filed an appeal against the acquittal of the 11 other accused by the lower court. Besides, the high court-appointed commission formed to look into the families’ demands of higher compensation is yet to give its report.

“We will continue our fight,” says Inbaraj, a tea stall owner who lost his two sons, aged 8 and 10, to the fire. “One died on the spot while another died at the hospital. Had they survived, they would have been in college now,” he says.

For Inbaraj, the conviction of the 10 is “too little, too late”. “The trial was delayed for almost a decade as the accused moved the high court and the Supreme Court and got frequent stay orders… most teachers ran for their lives without unlocking all the gates, and were acquitted,” he says though he is “happy” the state government has appealed against the acquittal of 11.
