Vodafone moves SC challenging provisions of taxable revenue under TDSAT
Firm argued that the TDSAT order is wrongly computing bad debt and discounts as revenue
New Delhi: Vodafone on Friday moved the Supreme Court, challenging the constituents of taxable revenue as defined by the Telecom Disputes Settlement Appellate Tribunal (TDSAT).
On 23 April, the tribunal had ruled that revenue from non-core sources must be included while computing a carrier’s adjusted gross revenue (AGR), which would force telecom companies to pay more towards licence and spectrum usage fees.
Lawyer P. Chidambaram appearing on behalf of Vodafone argued that the TDSAT order is wrongly computing bad debt and discounts as revenue. The TDSAT order will be referred back to the department of telecom (DoT) to recompute the revenue as per the order.
The DoT has also challenged parts of the TDSAT order. A bench comprising of justices Eqbal and N. Nagappan said both appeals shall be heard together. The next date of hearing is 8 September.
