Courts have constraints but never failed: HC judge

High Court judge A. Ramalingeswara Rao on Sunday said people should never doubt whether the rule of law exists in society as they are able to lead their lives peacefully. Along with other arms of democracy, courts have been successfully fulfilling their mandate, which is to deliver justice and intervene in matters of public interest in spite of their constraints, he observed.

Speaking at a seminar on ‘Rule of law- Role of courts’ organised by Potturi Bharati Foundation on Sunday, Justice Ramalingeswara Rao said thousands of cases are being admitted every day as the public reposed confidence in abilities of courts to deliver justice.

The number of cases piling up in courts was another side of the story. Nevertheless, justice delivery never stopped while the litigants were encouraged to mend fences through the Alternative Dispute Resolution (ADR) mechanism.

This would bring down the number of cases pending in courts substantially. Justice Ramalingeswara Rao further observed that health care and education have gone into the clutches of corporate sector to some deleterious consequences and attributed the trend to the so called ‘LPG (liberalization, privatization and globalization) policies’.

“People should not depend on governments for everything. But when the governments do not function properly, the courts will do their bit to extract accountability through public interest litigations and other legitimate means”.

Establishment of corporate hospitals has become a costly affair and returns were obviously expected. Society had to put up with such harmful tendencies, the HC judge added. Principal District Judge B. Ravindra Babu, Metropolitan Sessions Judge R. Niranjan, AP Bar Council member S. Rajendra Prasad, Bezawada Bar Association president Ch.S.V. Jagadeeswara Rao, Siddhartha Law College Principal Ch. Diwakara Babu and DSR Hindu Law College (Machilipatnam) Principal V.J.S. Rayalu were among those present.
