Thakur moves CJM court, seeks FIR against Mulayam by police
LUCKNOW: Suspended IPS officer Amitabh Thakur on Friday moved the court of chief judicial magistrate (CJM) Som Prabha Misra in Lucknow seeking instructions for the police to register an FIR against Samajwadi Party (SP) president Mulayam Singh Yadav for threatening him on phone.
“The court has registered the complaint and called for a report from Hazratganj police station.
August 4 has been fixed as the next date of hearing,” said Amitabh’s wife and social activist Nutan Thakur. The application has been filed under section 156 (3) of the Criminal Procedure Code (CrPC) which provides for an individual to approach the court and seek directions for the police to register an FIR and investigate the same.
On July 11, Amitabh Thakur, who was then posted as inspector general of police (IG) civil defence, had filed a complaint with the Hazratganj police station, seeking an FIR against Mulayam under section 506 (criminal intimidation) of the Indian Penal Code (IPC). In his complaint, Thakur had stated that Mulayam had threatened him on phone for lodging an FIR against mining minister Gayatri Prasad Prajapati and others.
However on July 24, in charge of Hazratganj police station inspector Vijay Mal Yadav informed Thakur through a letter dated 17 July that his complaint had been inquired into and that no case was made out in the incident. In his application to the court, Amitabh has questioned the police inquiry and alleged that Mulayam Singh phoned him on July 10 and criminally intimidated him.
