Appointment ‘Muddle’: UPPSC chairman told to reply on PIL challenging his job

PIL alleges that he has been at centre of many controversies, including the charge that he was favouring a particular community in recritments.

The Allahabad High Court on Monday deferred the hearing of a PIL challenging appointment of Uttar Pradesh Public Service Commission (UPPSC) chairman, Dr Anil Yadav, till August 13. The court has sought reply on behalf of Yadav.

A division bench, led by Chief Justice D Y Chandrachud, sought personal reply on various issues raised in the PIL filed by advocate Satish Singh, regarding the appointment of the chairman. A detailed order was awaited.

Representing the state government, Advocate General Vijay Bahadur Singh said: “The court passed the order as the notice was not served on the chairman, who was made a party to the case by name. It is essentially a technical requirement as there should be a reply from the person, who has been named respondent by name. The matter will be heard on August 13”.

The petitioner’s counsel, Gyanendra Srivastava, said the court has sought reply on the issues raised in the PIL “regarding the circumstances in which Yadav’s appointment was done and the deliberative process that was resorted to by the state government in this matter. Notice was served to him, but the chairman has not filed any rebuttal.”

The PIL alleges that Yadav, who has been at the centre of many controversies, including the charge that he was favouring a particular community in recritments, was appointed without following due procedure.

Aspirants and candidates for various competitive examinations for government services have been alleging that merit was being compromised in the recruitment process conducted by the UPPSC under Yadav, who took charge as the chairman on April 2, 2013, for a period of six years. He had earlier served as member of the UPPSC during the previous Samajwadi Party government.
