HC quashes debarring of B.Tech. student

: The Kerala High Court on Wednesday quashed the order of M. G. University debarring a candidate from appearing for B.tech examinations on charges of copying.

Justice A. V. Ramakrishna Pillai passed the order while allowing Teenu Susan Titus of Aranmula against the university order.

Teenu was 6th semester student of B Tech Civil Engineering at the Carmel Engineering College, Kottayam.

The petitioner pointed out that though the invigilator did not report any case of malpractice, the teachers at the valuation camp reported that a few answers of the petitioner and another student who sat on the back row were similar.

The order had been passed without giving an opportunity of being heard, the petitioner contended.

The petitioner’s lawyer submitted that the petitioner was academically a brilliant student who had secured higher marks all through the school and college.

Inconsistent stand

The court observed the inconsistent stand taken by the university on the issue had created genuine doubt against the charges levelled against the petitioner.

The court was of the opinion that the university passed an order without applying mind.
