The counsel for the state government on the Jat reservation issue told the Rajasthan High Court on Monday that he would come back with the government’s decision on whether the matter should be sent to the Rajasthan State Backward Classes Commission for review or it would want the court to hear the case on its merit instead. The next hearing is slated for Tuesday.

A bench of Chief Justice Sunil Ambwani and Justice Ajit Singh asked that when the National Commission for Backward Classes had declined to grant OBC status to Jats from Bharatpur and Dholpur, on what basis could it continue at the state level.

To this, senior advocate representing the Jat Mahasabha, Jagdeep Dhankhar pleaded that there was “no connect between the two”. He maintained that the NCBC at the Central level had declined reservation to Jats in Delhi, Uttar Pradesh, Madhya Pradesh, Gujarat and Haryana also, but the reservation at the state level continues.

The court sought to know the stand of state government. Senior advocate Rakesh Dwivedi said the court could issue a judicial order for re-examination of the matter by the Rajasthan State Backward Classes Commission that will be fully constituted shortly.
