SITEKI – A man has been fined E200 or two months imprisonment for making unkind and insulting remarks towards an HIV positive woman.

However, Absalom Magongo’s walked free after his sentence was suspended for a period of three months by Swazi National Court (Siteki) President Johannes Khumalo.

Magongo (47) of Mpolonjeni near Siteki was found guilty of crimen injuria in that he uttered unpalatable words to an HIV positive woman (name deliberately withheld).

It is reflected on the charge sheet that Magongo said the following words to the HIV positive woman: Uneligciwane, utawucedza bantfu (you are HIV positive, you will kill people).

According to the woman, Magongo uttered these words outside her flat at Mzilikazi near Siteki on June 16, 2015.
As a result, the woman told the court that she was offended by Magongo’s utterances, hence she reported the matter to the police, who in turn charged Magongo with crimen injuria. Magongo, however, pleaded not guilty when the charge was read to him.
He argued that the complainant had fabricated the story.

“The complainant still holds grudges following that I took her friend to court about a week ago. I never uttered such words. On this day in question, I only warned my wife about sharing her ARVs with the complainant,” Magongo said while insisting on his innocence.
However, the woman insisted that Magongo uttered unpalatable words towards her.
