GDA to prepare DoD for 3 defaulting apartments

The Ghaziabad Development Authority has employed an architect to prepare the Deeds of Declaration (DoD) for three apartments in Indirapuram.

GHAZIABAD: The Ghaziabad Development Authority has employed an architect to prepare the Deeds of Declaration (DoD) for three apartments in Indirapuram. This comes following an Allahabad High Court order in January on the petition of Federation of Apartment Owners’ Association, in which it was said that builders of Amarpali Royal, GC Grand and Neo Scottish had not provided DoD to flat owners as required under the UP Apartment Act.

The court had directed the GDA to prepare the DoD and provide the same to flat owners. Dayanad Prasad, officer on special duty, GDA, said, “We have roped in architect G C Khurana of Space Art Consultant to prepare the DoD as per court’s order. While the DoD of Amarpali Royal and Neo Scottish is being prepared, that of GC Grand has been submitted by the architect.”
Alok Kumar, the petitioner and president of the Federation of Apartment Owners’ Association, said, “Even for RWA election a DoD is required. Residents of these three apartments complained that the builders were dragging their feet on the matter, and this forced me to file a petition in the court.”
Kumar claimed that though every builder under is supposed to prove the DoD to flat owners under the UP Apartment Act, they often as reluctant to hand over the document. It has been mandated under the Act that any deviation from the DoD empowers a flat owner to drag the builder to the court. “That is the sole reason builders hesitate in handing over DoDs to flat owners,” said Kumar.
The GDA is responsible for keeping a tab on builders who have not provided the DoDs. In December last year, the Authority had sent a notice to at least 300 builders for either not providing the DoD to flat owners, or giving incorrect information. “Out of 300 only 50 responded to the GDA notice. But with court’s order, GDA has taken unto itself to prepare the DoD and it is a good start,” said Kumar.
