This Reexamination Proceeding was initiated (by Keneric Healthcare) in response to the '764 patent infringement case filed against Keneric Healthcare by Hydrofera, LLC, a subsidiary of Hollister, Inc., in November 2013. The rejected claim is the only claim involved in the ongoing '764 patent infringement case filed by Hydrofera, LLC. "The PTO's repeated rejection substantiates our continuing belief that the '764 patent is invalid," Keneric Healthcare's President Dr. Jean Achterberg said.
