UT tells HC illegal hotels in Burail, Kajheri, Attawa villages liable to be demolished

The information was submitted on Tuesday during the resumed hearing of a bunch of petitions filed by around 120 hotels.

The Chandigarh Administration has informed the Punjab and Haryana High Court that over 100 illegal hotels that have mushroomed in Burail, Kajheri and Attawa villages are liable to be demolished as the Punjab Municipal Corporation Act as extended to Chandigarh and Capital of the Punjab (Development and Regulation) Act, 1952, is applicable to those areas.

The information was submitted on Tuesday during the resumed hearing of a bunch of petitions filed by around 120 hotels and owners of guest houses in Kajheri, Burail and Attawa, who had been issued notices by the Chandigarh Municipal Corporation highlighting illegalities in their buildings and had been directed to submit revised building plans.

Taking the Administration’s reply on record, the division bench comprising Justices Rajive Bhalla and Amol Rattan Singh adjourned the case till July 2. Last year, the Corporation had ordered that in case the hotels and guest houses failed to submit the revised building plans, their structures would be demolished. But the court had in December stayed the Corporation’s notices.

The petitioners had informed the court that there was a division bench judgment earlier, wherein it was held that the Capital of the Punjab (Development and Regulation) Act, 1952, was applicable to the area, which was notified to be part of Capital Project prior to November 1, 1966, and that Kajeri village was not part of the Capital Project. Therefore, the rules framed under the Capital of the Punjab Act are not applicable to Kajheri though the premises shall be governed by the Punjab Municipal Corporation Act as extended to Chandigarh.
