Haryana to HC: Info about corruption cases concerning babus can't be given under RTI Act

The Haryana government on Tuesday submitted before the Punjab and Haryana high court that information related to involvement of IAS, IPS, HCS and HPS officers in any corruption case was 'personal information of the officers' concerned and couldn't be provided under the RTI Act.

CHANDIGARH: The Haryana government on Tuesday submitted before the Punjab and Haryana high court that information related to involvement of IAS, IPS, HCS and HPS officers in any corruption case was 'personal information of the officers' concerned and couldn't be provided under the RTI Act.
According to the state, the information couldn't be provided because action against such officers was a relation between 'employer and employee'.
The government submitted that such information couldn't be disclosed to the public under the RTI Act.
The information was provided by the government in response to an appeal filed against the orders of the state information commission (SIC), which had denied to provide details of corruption cases registered against IAS, HCS IPS and HPS officers of Haryana cadre under the RTI Act. During the hearing of the case before SIC, it had denied information on the ground that the involvement of a public servant in corruption cases was 'personal information' and a 'matter between employer and employee.'
In his appeal, RTI activist Subhash Chander had pleaded before the HC that the public had the fundamental right to know about the civil servants' conduct, especially in reference to corruption cases registered during the discharge of their public duties.
He had maintained that the officials involved in corruption cases don't have any right to privacy and disclosure of such information was larger public interest. Counsel for Subhash had also argued that media was at liberty to comment about the cases against layman, but in case of a public servants such information had been withheld. The case would now come up for hearing before the HC on October 19.
