‘Loyal’ Carmine’s waiter suing restaurant over no overtime pay

A longtime Carmine’s restaurant waiter is suing the Italian eatery for failing to pay him overtime, according to a new lawsuit.

Raul Pichardo, who’s worked at the Upper West Side location of the famed restaurant for 22 years, claims he was routinely stiffed out of pay despite working 60 hours a week, says the Manhattan federal court suit filed by attorney Matthew Blit.

“Mr. Pichardo was required to work through his breaks and was required to clock out and continue working on a daily basis,” court papers say.

Under New York labor laws, Pichardo is entitled to back wages for six years.

The suit alleges that he worked in excess of 60 hours between April 2009 and November 2014.

The suit could potentially cover thousands of other waiters like Pichardo who were gypped out of overtime, and millions of dollars could be at stake, sources said.

Pichardo’s suit names Carmine’s, as well as the restaurant’s parent company Alicart Inc., as defendants.

Carmine’s didn’t immediately comment.
